Ichter Prevails in $150 Million Bond Validation

On October 2, 2014, Cary Ichter represented the Development Authority of Fulton County in a bond validation hearing at which a transaction involving $150 million of bond financing for Three Alliance Buckhead, L.P was approved. The project involves the acquisition, construction and equipping 12,000 square feet of retail space and 490,000 square feet of office space. It is estimated that the project will generate approximately 90 new full-time permanent jobs, 10 part-time permanent jobs and 100 construction jobs.

Mr. Ichter has been involved in the validation of nearly $4.2 billion of development bond transactions since 2010. Most of those validation proceedings have been contested. None of the contests has succeeded. “I am very pleased whenever we are able to get one of these transactions validated and confirmed,” said Mr. Ichter. “We should be doing everything we can to promote economic development and the creation of jobs in Fulton County. It is always nice to win a case, but it is even better to participate in facilitating projects that create jobs, opportunities and prosperity in our community.”

My name is Bob Shaw. I have been the Chairman of the Development Authority of Fulton County (DAFC) since 2002. Since 2010, Cary Ichter has been DAFC's lead litigation counsel. Cary's first case with DAFC was a complex case in which a county resident challenged DAFC's bonds for a title program, a program which has resulted in the successful development of billions of dollars of projects and the creation of tens of thousands of jobs in Fulton County. Our adversary claimed that the program was illegal and unconstitutional, and sought to unravel over $5 billion worth of projects, which would have been a disaster for the businesses involved, their employees and their tenants.
