On November 29, 2012, Cary Ichter and William Daniel Davis, along with Michael Tyler of Kilpatrick Townsend & Stockton LLP, had the pleasure of leading a presentation titled “How Do You Spell Relief: INJUNCTION” to members of the Franchise and Distribution Law section of the State Bar of Georgia. The State Bar, of course, is the mandatory association of attorneys licensed in Georgia, and the Franchise and Distribution Law section is one (1) of forty-five (45) sections that provide a conduit for information and promote education and best practices in particular areas of law.
Franchise law is of particular interest to Mr. Ichter, who currently represents several franchisors and franchisees engaged in variety of businesses. In part, this is due to Cary’s experience, including, most recently, obtaining and confirming an award in a consolidated arbitration proceeding with a value of about $6.5 million.
Whether you are a franchisor interested in protecting the goodwill associated with your marks or a franchisee seeking to halt an attempted termination of your agreement, we can help, including advising you with respect to the tactical advantages and potential pitfalls of preliminary injunctive relief, how recent changes to Georgia law have radically changed the enforceability of restrictive covenants, and whether recent Supreme Court decisions make state court better suited for trademark infringement actions.
We would be happy to assist you in translating your legal challenges into business opportunities – it’s what we do every day. If you think we could help you, please give Cary Ichter or William Daniel Davis a call at 404-869-7600.
