Judge Tosses FedEx Suit Over Re-Sold Shipping Discounts

As featured in the January 4, 2018 issue of the Fulton County Daily Report, Ichter Davis successfully persuaded the United States District Court for the Northern District of Georgia to throw out claims by Federal Express that it was “defrauded” of more than $1.5 million by a man who allegedly “high-jacked” a corporate account offering discounted shipping rates.  In its Complaint, FedEx alleged the man, through false pretenses, linked his FedEx account to a large customer with substantial shipping discounts, and then ran a third-party shipping operation that deprived FedEx of $1.5 million in profits.  The man’s attorney, William Daniel Davis of Ichter Davis, moved for summary judgment on numerous issues, arguing no trial was necessary because none of FedEx’s claims were viable.  The Court agreed, writing that FedEx’s claims of fraud, unjust enrichment, and tortious interference with business relations all failed as a matter of law.  FedEx did not appeal the ruling, which eliminates any risk of civil liability for the man.
