UPDATE: GEORGIA HOUSE OF REPRESENTATIVES PASSES PROPOSED CONSTITUTIONAL AMENDMENT CREATING BUSINESS COURT

UPDATE: GEORGIA HOUSE OF REPRESENTATIVES PASSES PROPOSED CONSTITUTIONAL AMENDMENT CREATING BUSINESS COURT

February 28, 2018 was “Crossover Day” for the 2017-2018 Georgia legislative session. For those unfamiliar with the Georgia legislative process, all legislation must pass in one chamber by Crossover Day to continue through the legislative process during a session.   By a vote of 142 to 25, the House passed HR 993, which would amend Georgia’s constitution to create a statewide Business Court.  The content of the proposed amendment is substantially similar to the version I previously reported on.  The House Judiciary Committee did make one important change, however.  Under HR 993, the Business Court would have equitable powers co-extensive with Superior Courts.

Ichter Davis will continue to closely track legislative action on this issue during the session.  Stay tuned for updates.
